About the EasyPark Privacy Policy
This website (www.easypark.com.au; www.easypark.nz) and our mobile application (collectively, the “EasyPark Platform”), the products or services sold on, or via, the EasyPark Platform are created, operated and controlled by EasyPark ANZ Pty Ltd (ABN 15 160 029 470; NZBN 9 429 048 368 964) (“EasyPark”, “we”, “us” or “our”). EasyPark is an Australian company that is a wholly owned subsidiary of Modern Payment Solutions (ABN 99 153 968 757), a licensee of the EasyPark AB.
We are committed to ensuring your personal information is protected. We manage the personal information of users in Australia and New Zealand in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) and the Information Privacy Principles set out in the Privacy Act 2020 (NZ) (collectively, “Privacy Laws”).
By accessing and using and continuing to the EasyPark Platform and the products or services made available to you on, or, via, the EasyPark Platform, you agree to this Privacy Policy.
This Privacy Policy outlines how we collect, store, use and disclose your Personal Information, and how you may access your Personal Information (as defined in the Privacy Laws) kept by us or how you may make a privacy complaint.
Contacts covered by this Policy
This Privacy Policy applies to all products and services provided in Australia or New Zealand by EasyPark including, but not limited to, products and services made available to you on, or via, the EasyPark Platform. If you do not wish to agree to the terms of this Privacy Policy, we are unable to provide you with access to, and use of, the EasyPark Platform and our products and services. In such a case, you should leave the EasyPark Platform and not register to access and use our products and services.
Types of information collected
There are two types of information collected:

non-personal information.
What is Personal Information?
Personal Information, for the purposes of this Privacy Policy, is information about and which identifies individuals, such as;

your username and password when you register with us or update or add information to your account (including security question, such as your city of birth or your pet’s name);

information provided by or on behalf of applicants for employment.
In general, EasyPark will not use or disclose Personal Information collected about you other than for a purpose set out in this Privacy Policy, for a purpose for which you would reasonably expect disclosure, a purpose required or permitted by law, or a purpose otherwise disclosed to or authorised by you.
What is non-Personal Information?
Non-Personal Information is information that does not identify you as an individual, such as your browser type, IP address, the URL of previous websites you have visited, parking patterns and usage etc. EasyPark may automatically collect certain types of non-Personal Information from you when using EasyPark Platform. We may also collect non-Personal Information that you voluntarily provide, such as information included in response to a questionnaire or survey. The collection, use and disclosure of non-Personal Information is not subject to Privacy Laws.
Collection of Personal Information from you
We will collect Personal Information about you in a number of different ways. We may collect Personal Information directly from you or in the course of our dealings with you. For example, when:

a user accesses and uses the EasyPark Platform (including when a user opens an account or creates or adds information to their account on, or, via, the EasyPark Platform);

a user plans, finds and manages a parking session on, or via, the EasyPark Platform
-
you contact and correspond with us or make a general enquiry about the EasyPark Platform, or any products or services sold on, or via, the EasyPark Platform (for example, when you complete online forms or subscribes to our publications, alerts and newsletters, or information you provide to us when you send us an email);

visit the EasyPark Platform (including via cookies), contact us online or via telephone or email with a query or request, or make a comment on our social media sites;

provide your Personal Information to third parties (including to our related bodies corporate, business partners, suppliers, sellers, vendors and other service providers, credit reporting bodies, credit providers, government agencies, public registries, search agencies, regulatory and licensing bodies, parties to whom you refer us (for example, previous employers and referees), recruitment agencies and from publicly available sources of information (for example, online databases and social media)); or

when you apply for freelance work or a position of employment with us; or

when otherwise legally authorised or required to do so.
Information collected about you from third parties
EasyPark may also collect Personal Information about you from third parties. If your consent to such collections are required by law, we will first obtain your consent prior to the collection of the information. For instance, to protect against potential fraud, we may use third parties to verify the information you provide. In particular, if you register a credit card with EasyPark, we may use card authorisation and fraud screening services to verify that your card information and address matches the information that you supplied to EasyPark and that the card has not been reported as lost or stolen. In some circumstances, we will conduct a background check on your business by obtaining information about you and your business from a credit bureau or a business information service, which may result in the collection of personal information.
Information Collected from you about third parties
If you provide to us Personal Information about someone else (for example, another user) we rely on you to inform them that you are providing their Personal Information to us and to advise them
that we can be contacted for further information. You must take reasonable steps to ensure the individual concerned is aware of and consents to the various matters detailed in this Privacy Policy, including the fact that their Personal Information is being collected, the purposes for which that information is being collected, the intended recipients of that information, the individual's right to obtain access to that information, our identity, and how to contact us. Where requested to do so by us, you must also assist us with any requests by the individual to access or update the Personal Information you have collected from them and provided to us.
How we use your Personal Information
EasyPark does not sell your Personal Information. EasyPark will only use and disclose your Personal Information for the purposes for which the information is collected, including (but not limited to):

providing users with access to, and use of, the EasyPark Platform, and to correspond with users who access and use the EasyPark Platform;

enabling users to plan, find and manage parking sessions on, or via, the EasyPark Platform;

providing users with access to location-based parking services (such as radius search and other content that is personalised on the basis of the user’s general location information);

facilitating the delivery of products or services to users and assisting with, or responding to, user queries;

provide general customer support services for users of the EasyPark Platform;

informing users about the EasyPark Platform, the products and services offered by EasyPark, about offers, promotions or other matters which we believe are of interest to you (such as recruitment or job opportunities);

share with our third party providers;

administering, improving and managing the EasyPark Platform (including customising the advertising and content on the EasyPark Platform), our relationship with users and the products and services sold or offered for sale on, or via, the EasyPark Platform;

charge and bill users to access and use the EasyPark Platform and the products and services made available on, or via, the EasyPark Platform;

verifying your identity and for fraud detection purposes. For example, we may report your credit card number to a service that screens for lost and stolen card numbers;

for internal record keeping;

for direct marketing purposes; and

complying with our legal and regulatory obligations. For example, legislation such as the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) may require us to ask you for information to check your identity (for example, by referring to your driver’s license, birth certificate or passport).
Disclosure to Third Party Providers
In order to make the products and services available to users and to make the EasyPark Platform available to users, we may disclose your Personal Information to:

our related bodies corporate, business partners, service providers, third party contractors, agents or suppliers, hosting companies, web developers, internet service providers, external business advisors or other authorised external service providers who perform functions on our behalf;

potential buyers of the EasyPark business, if we wish to sell any aspect of our business, as part of a merger or acquisition;

commercial parking providers for their direct marketing purposes;;

to third party suppliers and providers who provide hosting and marketing services;

our lawyers, financial advisors, accountants and IT professionals to enable them to perform the services we engage them to do;

law enforcement bodies or regulatory authorities to assist with their functions; and

as otherwise required or authorised by law,
collectively third party providers (“Third Party Providers”).
We also may disclose non-Personal Information, such as your vehicle registration number, to local councils, parking authorities or commercial parking providers for the purpose monitoring, verifying and enforcing your parking session. For example, local councils, parking authorities or commercial parking providers may receive your vehicle(s) registration number plate on their EasyPark statements and will receive details of whether the transaction was a stored value or pass-through transaction.
Prior to the disclosure of Personal Information to Third Party Providers, we will take such steps as reasonable in the circumstances to ensure that the Third Party Providers treat your Personal Information securely and otherwise complies with the relevant Australian Privacy Principles and New Zealand Information Privacy Principles in relation to the Personal Information.
EasyPark use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not collect, process, use, share, store or disclose any Personal Information or payment information (such as credit card and bank account details). Rather, all such information is provided directly to our third party processor (National Australia Bank) or any other third party payment processor we use from time to time,, whose use of your Personal Information is governed by their privacy policy.
Marketing communications
We may use and disclose your Personal Information to send you information about the products or services offered on, or via, the EasyPark Platform, as well as other information that may be of interest to you. Commercial parking providers may use your Personal Information to send you information about their carparking services, loyalty programs, promotions and discounts.
We and commercial parking providers may send this information in a variety of ways, such as by mail, email, SMS, telephone, social media or by customising online content and displaying advertising on our website.
If you do not wish to receive any of these marketing communications, you can opt out by following the unsubscribe instructions included in the relevant marketing communication, or by contacting us using the contact details set out below.
Overseas disclosures of Personal Information
In the course of providing you with our products or services, it may become necessary or desirable to disclose Personal Information to our licensor (EasyPark AB) or Third Party Providers located overseas. The countries in which these overseas recipients may be located will depend upon the individual circumstances. However, in the course of our ordinary business operations we commonly disclose the Personal Information of Australian and New Zealand users to:

our data hosting service providers located in Sydney, Australia; and
-
EasyPark AB who performs functions on our behalf, who are located in the European Union
-
services providers and third party contractors in the Philippines who perform administrative and support services on our behalf .
The laws where these overseas recipients may be located provide various levels of protection for Personal Information which are not always equivalent to the level of protection that may be provided for in Australia and Zealand. Where we transfer your Personal Information overseas we will take reasonable steps to ensure that your Personal Information is treated securely and the means of transfer provides adequate safeguards.

Information security
EasyPark is committed to the highest standards of information security and when dealing with your customer information, takes all reasonable care to prevent unauthorised access to, modification and disclosure of, your Personal Information. We use computer safeguards such as firewalls, data encryption, and a Secure Socket Layer (“SSL”) to transfer Personal Information between you and our web servers. We enforce physical access controls to our buildings and files and we authorise access to personal information only to specific employees who need it to fulfill their job responsibilities.
All employees and contractors of EasyPark are bound by the Code of Conduct and confidentiality clauses in their employment or contractor agreements whereby they cannot misuse your Personal Information. Those performing services on our behalf are also bound by privacy and confidentiality agreements restricting the use of your Personal Information.
Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, EasyPark cannot ensure or warrant the security of any information you transmit to us or from our online products or services and accordingly, you do so at your own risk.
We also require you to help us by complying with the security measures designed to protect your personal EasyPark password. These are set out in the terms and conditions of your account. You may be able to limit your liability for unauthorised use of your account if you observe these requirements.
If we no longer require your Personal Information, we will take reasonable steps to destroy it in a secure manner or remove identifying features from it. This is subject to any legal obligations we have to keep information for a certain period of time.
Data breach notification
In the event of any loss, or unauthorised access or disclosure of your Personal Information that has or is likely to result in serious harm to you, we will investigate and notify:

(Australian users) you and the Office of the Australian Information Commissioner as soon as practicable; or

(New Zealand users) you and the Office of the Privacy Commissioner as soon as possible.
Minors
The EasyPark is directed toward and designed for use by persons of the legal age to drive a vehicle in Australia. Individuals below this are considered Minors. We will not approve applications of, or establish or maintain accounts for, any Minor. We do not solicit or knowingly collect Personal Information from Minors. If we nevertheless discover that we have received Personal Information from an individual who indicates that he or she is, or that we otherwise have reason to believe is, a Minor, we will promptly delete such information from our systems.
Additionally, a Minor's parent or legal guardian may request that the Minor's Personal Information be corrected or promptly deleted from our files by contacting us using the details below.
Acceptance of policy
By visiting the EasyPark Platform, you are accepting the terms and conditions of this Privacy Policy. We reserve the right to modify this Privacy Policy at any time. Your continued use of the EasyPark Platform, after we either personally notify you of such changes or generally post such changes on the EasyPark Platform, will constitute your acceptance of those changes.
Your access to your Personal Information
To obtain access to your Personal Information:

you will have to provide proof of identity to ensure that Personal Information is provided only to the correct individuals and that the privacy of others is protected; and

we may charge you a reasonable administration fee, which reflects our costs in providing you with access to your Personal Information in accordance with your request.

Under certain circumstances, EasyPark may not be able to tell you what Personal Information we hold about you. This includes where:

-
we are prevented by law from disclosing information, or where providing access would prejudice certain investigations.
Do we keep your Personal Information accurate and up-to-date?
We take steps reasonable in the circumstances to ensure Personal Information it holds is accurate, up-to-date, complete, relevant and not misleading. Under Privacy Laws, you have a right to access and seek correction of your Personal Information that is collected and held by us. If at any time you would like to access or correct the Personal Information we hold about you, or you would like more information about our approach to privacy, please contact us by email at [email protected]. We will grant access to the extent required or authorised by Privacy Laws or other law and take steps reasonable in the circumstances to correct Personal Information where necessary and appropriate.
Complaints regarding breaches of privacy
If you believe that the privacy of your Personal Information has been compromised or is not being adequately protected, you should contact us. Our contact details appear in the “Contact Us” section of the EasyPark Platform. We will make every effort to resolve your complaint internally. If we do not resolve your complaint to your satisfaction, you may apply lodge a complaint with:

Third party websites and emails
As already stated, this Privacy Policy only applies to the EasyPark Platform. If you use a link from the EasyPark Platform to the website of a third party, that third party website is not subject to this policy or to EasyPark’s privacy standards. Any third party website is responsible for informing you of its own privacy policy. We have no liability or responsibility arising from the use of your personal information by any such third party website.
You should also be alert to any email or other communication requesting your password, asking you to provide sensitive account information via email, or links to a website with a URL that does not begin with https://www.EasyPark.com.au or https://account.EasyPark.com.au. Any such communication should be treated as unauthorised and suspicious and should be reported to EasyPark immediately by sending a notification by email to [email protected]. You must not give your personal or other information in response to any such communication.
Collection and use of non-personal information cookies
We may use cookie technology on the EasyPark Platform and gather data for website statistical reporting. Cookie technology does not contain any Personal Information about you.
A cookie is a small piece of information sent by a website that is saved on your hard disk by your computer’s browser. It holds information a site may need in order to personalise your experience. However, none of this is associated with you as an individual and is measured only in aggregate.
IP address
The EasyPark Platform may collect IP addresses for the purpose of systems administration, server problem diagnosis and compiling aggregate information (such as how many visitors logged on to the EasyPark Platform). When you visit the EasyPark Platform, our servers log your IP address. An IP address is a number that is assigned to your computer automatically or assigned by the network/domain from where you use the internet.
